BY ACCESSING THIS WEB SITE AND/OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW.

All services provided by MSI Direct Response are subject to Terms and Conditions of Service. By viewing this website or using any of our services, you and the entity you represent (collectively hereinafter referred to as "you" or "the client" or "the customer".) agree to be bound by all the Terms and Conditions as stated below without modification. If for any reason you do not agree with the Terms and Conditions as stated below, please do not access this site or use our services.

Change of Terms

MSI Direct Response reserves the right to change the Terms of Service at any time and these changes or additions become effective immediately when they become available on MailingTeam.com. MSI Direct does not assume the obligation to notify you of any changes to the Terms of Service. You are responsible for reviewing the Terms of Service for any changes, and continued use of this site constitutes your consent to these changes.

Age Requirement

MSI Direct Response does not sell products for purchase by children. If you are under 18, you may use MSI Direct Response only with the involvement of a parent or guardian.

Indemnification

You agree to defend, indemnify, and hold harmless MSI Direct Response, its advertisers, licensors, subsidiaries and other affiliated companies, and their employees, contractors, officers, agents and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your use of this site, or any services, information or products from this site, or any violation of this Agreement.

Third Party Affiliate Programs

The affiliate programs for which we offer printing and mailing services are not owned or controlled by us, and we assume no liability whatsoever related to their operations or the claims made in their advertising. The fact that we offer package deals for printing and mailing postcards for certain programs is not to be taken as an endorsement of them. It merely reflects that they are the ones for which we get the most orders. It is your responsibility to evaluate affiliate programs and the companies behind them. We are here to serve you regardless of what programs you choose to promote.

Copyright

Any content you submit to MSI Direct Response must abide by copyright laws. Unlicensed or misuse of copyrighted material from books, magazines, newspapers, photographs, web content, writers, artists, composers, publishers, and other authors is strictly prohibited. MSI Direct Response will not assume the responsibility of checking the content of your submitted materials for copyright violations. Therefore, MSI Direct Response will not be held accountable for any illegal use of copyrighted material by its clients.

Change Orders

If a Change is made to an existing order that results in a credit, a Fee will be charged in the amount of 10% of total credit amount, to cover transaction costs related to this credit.

Order Cancellation

Prior to printing, MSI Direct Response allows customers to cancel orders. Cancellation requests should be submitted by email to support@mailingteam.com. We will inform you of any charges depending on the stage of the order. Cancellation fees will be calculated based on the age of the order and whether a proof was created. Age will be calculated in calendar days from the date the order was placed. Once a job is printed and mailed there is no refund available.

Returns and Refunds

Customer orders have no re-sale value. Therefore, ALL SALES ARE FINAL. If the error is verifiably due to MSI Direct Response, we will re-print the order at our cost. Any defect/s you discover in your shipment must be reported to MSI Direct Response within 10 days of receipt. To qualify for a free replacement order, you must get a return authorization number from us and return your entire product within 15 days from the time you received it. We will give you credit for the return shipping cost.

All extra charges for rush printing or shipping are NON REFUNDABLE UNLESS UPS FAILS DELIVERY OR DELIVERS DAMAGED PRODUCT. Any credit due will be processed within 4 to 6 weeks. If you make a change to an existing order that results in a credit, a processing fee equal to 10% of the credit amount will be charged to cover transaction costs related to the credit.

Shipping and Delivery of Products

MSI Direct Response strives to meet all delivery schedules in a timely manner. However, we will not be held responsible for any consequential damages due to delayed production or delivery. Our shipment and delivery dates are based upon estimates provided by our shipment suppliers. MSI Direct Response will not be responsible for delays in shipments due to shipping company delays, international customs issues, weather conditions or any other circumstances beyond our control. Unexpected production or shipment delays can occur as a result of technical problems or equipment malfunction or failure. We will refund or waive rush charges/fees, where applicable, for a delay caused by such problems. However, we do not allow order cancellation based on such delays.

There will be an additional charge for any change to the shipping address made by the customer after the order is placed. If the customer supplies an incorrect shipping address causing the package to be returned to us, we will charge an additional fee for re-shipment to the correct address.

Claims for Loss or Damage

Claims for loss or damage must be made within 30 days of the shipment date. If the loss or damage was due to a 3rd party error, the claim must be filed against that party. In such a case, MSI Direct Response will not assume any responsibility, but will assist the customer in determining who the claim should be filed against.

Limitation of Liability

OUR LIABILITY IS LIMITED TO THE PRICE PAID FOR THE ITEM AND SHALL NOT INCLUDE ANY CONSEQUENTIAL DAMAGES OR DAMAGES FOR LOST PROFIT. WE HAVE THE RIGHT TO HOLD CUSTOMER PROPERTY (a lien) AS SECURITY FOR UNPAID BILLS. MSI Direct Response reserves the right to refuse service to any party for any reason it deems fit. PLEASE NOTE: ANY SUPPLIED MEDIA WILL NOT BE RETURNED. PLEASE DO NOT SEND ANY ORIGINAL MEDIA.

Office Hours and Observed Holidays

Office hours are Monday-Friday from 8:30 AM to 4:30 PM PST, excluding observed holidays. Express orders will be ready between 5pm and 8pm on the date they are due.

The following holidays are observed as business holidays. All operations as well as Customer Service are closed on these days. Holidays are excluded from Turn Time.

Mailing Services Terms and Conditions

We are not responsible for lost or non-delivered mail. The U.S. Postal Service does not track mail. Our responsibilities end when the U.S. Postal Service accepts the customer’s mailing from us. We will have a proof of mailing statement (3602-R for standard class, 3602-NP for the Non-Profit and 3600 for first class mail) that can be faxed to you upon request. First Class mail takes 1 - 5 days (average) to reach its destination. Standard Class and Non Profit mail take 7 - 20 days (average) to reach its destination. The U.S. Postal Service will not give a refund on postage for non-delivered mail. We are not responsible nor do we guarantee a response to the your mailing.

We understand that any mailing list you submit is privileged and confidential. It will not be used or sold for any purposes other than your mailing. Upon request we may archive the your list but will not be held responsible in case of system failure. You should always keep a copy of your own list.

In the event of a mistake or error, we will be liable only up to the cost of goods and services provided. By using our services, you agree that we will do accept liability for any loss of revenue or implied or consequential damages.

Print and Mail Package

The print and mail package includes list rental, printing, mailing services, and postage. This is a package deal and is all inclusive. It cannot be broken into separate groups. We can ship you any number of extra cards for an additional cost. The cards come with specific options that cannot be changed. If you must vary from the package deal, we will still be glad to print and mail your package. It's just that you have to order it separately. Customer Service can assist you with any further information on this.
